It is a crime in Illinois to offer someone money, property, or other compensation in exchange for sexual acts. Under 720 ILCS 5/11-14.1, a first offense for solicitation will be charged as a Class “A” misdemeanor. A conviction can result in up to one year in jail and fine of up to $2,500. If, however, the victim (the person being solicited) was under the age of eighteen or mentally disabled then the defendant will be charged with a Class 4 felony with a maximum sentence of one to three years.

Solicitation cases will begin with the defendant entering a plea of “guilty” or “not guilty” at an arraignment. It is the prosecution’s burden to prove that a crime occurred. If statements were taken from the defendant in violation of his or her Miranda rights, or through means which violated the Fourth Amendment, then it may be possible to keep such statements out of court. Also, the prosecution must be able to prove intent and that the “offer” was serious rather than a joke. The ultimate issue of guilt or innocence will be decided by a jury and a Judge, should there be a conviction, will issue a sentence.
