This is the first post in a series of articles which will address the handling of probation violations in Peoria and other Illinois areas. I feel it is important to write on this topic due to the fact that many are unsure of what rights they do, and do not, have while they are on probation. This lack of information can result in one’s being unnecessarily revoked. I am writing this series with the goal of providing information which people can use to address misunderstandings. It is also my goal to provide information which can assist with the selection of an attorney. If you or a loved one are in need of assistance then contact my office today to speak with a criminal defense lawyer.
I will be addressing multiple topics over my coming articles. Issues which I will be analyzing include the following:
- The rights of one who is on probation
- What to expect at a violation hearing
- Gaining reinstatement after a violation
- Negotiating a revocation
- The importance of having an attorney to assist you
I have chosen to address these particular topics for multiple reasons. First, when one is on probation then they do not enjoy the rights of a typical citizen. Knowing what rights one does, and does not have is critical to making sure they are navigating the process correctly. Second, a violation hearing is not a trial. There is no jury and the final decision is up to the Judge. Third, it is possible to gain reinstatement after a violation. Gaining reinstatement will often involve a defendant agreeing to additional conditions. Fourth, if a reinstatement is not possible, it may be possible to reduce a sentence as part of agreeing to a revocation. Finally, having an experienced representative can be important to making sure that you are making the strongest arguments before the Court.
If you or a loved one require legal assistance then contact my office to speak with a Peoria probation violation lawyer. I understand the gravity of the situation and that any upcoming hearing may determine a person’s freedom. I believe that everyone is entitled to a second chance, effective representation, and respect. We look forward to speaking with you.
