This is my next post in a series of articles which address the topic of money laundering charges in Peoria, Illinois. My last article discussed the different types of conduct that can constitute money laundering. It also pointed out how important it is to contact an attorney as the first step after being charged and to avoid all contact with any alleged victims. In this article, I will explain whether money laundering is a misdemeanor or felony in Illinois and break down the differing levels with the accompanying penalties. If you are facing money laundering charges and need assistance then contact my office today to speak with a criminal defense lawyer.
All levels of money laundering will result in Illinois felony charges
In the state of Illinois, all levels of money laundering result in a felony charge. There are no misdemeanor-level charges for such conduct. The severity of the charge depends on the amount of money involved. Under 720 ILCS 5/29B-1, laundering up to $10,000 is a Class 3 felony and carries a sentence of two to five years in prison with fines up to $25,000. This charge is probationable, which means a judge could allow an individual to serve their sentence on probation rather than in prison. Laundering amounts between $10,000 and $100,000 is a Class 2 felony and is punishable by three to seven years in prison with fines up to $25,000. Courts are not as likely to grant probation for this class of felony. When a person launders between $100,000 and $500,000, the offense rises to a Class 1 felony. This felony is punishable by four to fifteen years in prison, fines up to $25,000, and no possibility for probation. Laundering $500,000 or more is classified as a Class X felony and carries a sentence of six to thirty years in prison with no probation allowed. This class of felony is the most serious category and those convicted could face asset forfeiture and severe fines.
Money laundering has lasting consequences in addition to prison sentences and fines. Having a felony conviction can prevent a person from obtaining professional licensing in various fields. A felony conviction becomes part of a permanent criminal record and can greatly affect one’s ability to get a job, pass background checks, and qualify for housing. Such a conviction also prevents a person from possessing a firearm under both Illinois and federal law.
An individual may face additional charges if laundering money was committed with another crime or the money was obtained as part of another crime. This offense is often committed alongside other financial or organized crimes, which can result in more severe penalties.
Retain a Peoria defense attorney immediately if you face money laundering charges
Money laundering cases are complex because of the detailed transactions, requirement for intent, and potential constitutional issues like unlawful searches and seizures. These charges are often accompanied by other serious crimes like fraud, drug trafficking, or conspiracy, which add to the complexity. An experienced attorney can help analyze bank records, business transactions, and other evidence. These serious charges can result in severe consequences without the help of a lawyer. An individual facing federal charges must hire a lawyer who is licensed to practice in Federal Court. Charges may be federal when the conduct is related to federal crimes or involves interstate or international transactions.
