Illinois considers the Juvenile Court process to be different than the system faced by adults. Rather than considering young people “criminals” and “convicting” them of an offense, the juvenile system will adjudicate the young as a “delinquent.” To many, however, these differences seem superficial. Young people still run the risk of incarceration, having to pay restitution, and having to serve out other penalties typically associated with criminals. The Juvenile Court will hear most matters where a young person, under the age of 17, committed a misdemeanor or a felony.
Juvenile cases begin with an arraignment at which the accused youth will enter a plea of “guilty” or “not guilty.” Common charges young people face involve drug possession or crimes of violence. Such cases often hinge on whether or not law enforcement violated a youth’s right against unreasonable search and seizure as well as the right to remain silent. If such violations occurred then an attorney can request that illegally obtained evidence or statements be excluded from Court proceedings. Should a trial be necessary then the matter will be heard by a Judge, and not a jury. Courts tend to have broad discretion in juvenile matters and it is strongly suggested that you retain counsel to help you with the process.
