gavel book and cuffsThis article is being written to conclude and recap my series on charges involving Class 2 felony theft in Peoria and other Illinois areas. I considered writing on this topic to be important as many individuals are surprised at the level of charges which they face. It is important to understand that one may be facing a prison sentence and, therefore, it is important to speak with an attorney as soon as possible. I wrote these articles with the goal of providing information which will assist with the selection of counsel. It has also been my goal to provide information which can help people to better understand their predicament. I addressed a number of topics over my recent articles. Issues which I analyzed included the following:

I addressed these particular topics for multiple reasons. First, many defendants are surprised that certain types of property can have a value which equates to a Class 2 charge. It is important to remember, however, that charges are based on the value of property and not on the nature of it. Second, individuals often wonder whether they can go to prison for such a charge. The answer to this question is “yes.” Third, while one can receive probation, whether or not to grant it is entirely within the discretion of the Judge. Fourth, if law enforcement violated the Fourth or Fifth Amendments then, depending on the facts of the case and the nature of the charges, it may be possible to gain a dismissal. Finally, retaining an attorney who is well-versed in such matters can be an important step towards protecting one’s rights.

A key point I made in each of these articles is that one should contact counsel sooner and not later. The sooner you retain an attorney, the sooner your representative can begin to build a case on your behalf. I am a former prosecutor who now devotes his practice to protecting the rights of the accused. I understand that this is a serious time in your life.
